Second Degree Murder?

This may sound like a peculiar thing to say, and I’m essentially kidding, but all this police homicide gives us an opportunity to brush up on the differences between various types of murder and manslaughter.

I’m going murder 2 on this one, which generally means: “Any intentional murder with malice aforethought, but not premeditated or planned in advance.”

In Oklahoma, murder 2 is defined differently, however; where it’s “an imminently dangerous act that killed another without any deliberate intent to kill or premeditation.”

Given that, he may be charged with murder 1, since not caring that your victim can’t breathe sure sounds like intent to kill to me.

In either case, he should do at least 20 years.  Bye, ass****.
